I. General Terms and Conditions of Diana Models Agency
The following general terms and conditions concern, on the one hand, the brokerage service of the agency Diana’s Models (hereinafter referred to as “agency”) and the general terms and conditions of the respective service provider (hereinafter referred to as “model”) towards the respective service recipient (hereinafter referred to as “customer”).
Legal provisions remain unaffected by this.
1. Contract between agency and model
The agency has no contractual relationship with the customer. It provides the models with an online portal on which they can advertise their services. Details about these services are regulated in the models’ general terms and conditions or their respective individual contractual agreements with the customer. The nature of the encounter is determined exclusively by the model and the customer under their responsibility. The customer does not conclude a contract with the agency.
2. Visual and textual representation of the models’ services
The descriptions on the website www.dianasmodels.com are based on details and information provided by the respective model; the agency assumes no liability for the content.
3. Payment, authority to receive money
The agency does not charge the customer any fee. The respective services are settled directly between the customer and the model. If the agency is exceptionally entitled to the fee, it has the authority to receive money for this purpose.
II. General terms and conditions of the models
1. Conclusion of contract
A contract between model and customer is only concluded when the model accepts the non-binding request sent by the agency and the agency informs the customer of this.
2. Type and scope of the models’ services
The essential contractual components (duration, type and manner of service) of the service contract concluded between the model and the customer are determined between the contracting parties on their own responsibility. Otherwise, the general terms and conditions apply.
3. Fees
The prices on the website www.dianasmodels.com refer exclusively to the time and company of the models and not to any additional services. This includes the agency commission for marketing services.
Any travel costs incurred by the model are not included and will be estimated separately before the meeting.
The model is generally entitled to demand reimbursement of travel expenses and a deposit of up to 40% of the hourly fee from the customer. The customer transfers the deposit to the agency’s account in advance. The agency is authorized to accept the money from the respective model.
The remaining amount of the agreed hourly fee and the travel expenses must be handed over to the model in cash in an open envelope at the beginning of the meeting without being asked to do so.
